Terms of service

The deal between you and Artyphonic — what you can expect from us, what we expect from you, and how the money and your work are handled. Plain language, no traps.

These terms are a contract between you and SCARABYTE DIGITAL S.R.L., a company registered in Romania (“Artyphonic”, “we”, “us”), operator of artyphonic.com, the studio app, the client Rooms and the free producer tools (together, the “Service”). By creating an account or using the Service, you agree to them. If you use Artyphonic on behalf of a business, you confirm you can bind it.

Short version: your work and your client relationships are yours. You pay us a subscription for the studio; your clients pay youdirectly through your own Stripe account and we take none of it. Don't upload things you don't have the rights to, and don't abuse the Service. The longer version is below.

1. The agreement

These terms, our Privacy policy, and any plan-specific terms shown at checkout make up the whole agreement between us. If any part is unenforceable, the rest still applies. We may update these terms (see §16); continued use means you accept the changes.

2. Accounts

You must be at least 16 and provide accurate details. You are responsible for your account, your password, and everything done under it. Keep your credentials safe and tell us promptly at hello@artyphonic.com if you suspect unauthorised use. Your clients do not need an account — they use a private Room link you control.

3. What Artyphonic is

Artyphonic gives mix and master engineers a studio dashboard and a private, branded Room per client: versions, timestamped notes, approvals, a finishing-pack handoff, and direct payment. It also offers free, in-browser producer tools. We provide the platform; we are not a party to the creative or commercial relationship between a studio and its client.

4. Subscriptions & billing

  • Paid plans are billed in advance on a recurring basis through Stripe. Prices and features are shown at checkout.
  • Any free trial converts to a paid plan unless you cancel before it ends.
  • You can cancel anytime; cancellation stops the next renewal and you keep access until the end of the paid period. Except where the law requires otherwise, fees already paid are non-refundable.
  • We may change plans or prices with reasonable notice; changes apply from your next billing cycle.
  • Taxes may be added where applicable.

5. Studio–client payments

When your client pays to unlock files, the payment is made to your own connected Stripe account via Stripe Connect. You are the seller and merchant of recordfor that transaction; Artyphonic is not a party to it and takes no commission. You are responsible for delivering what you sold, for any refunds or disputes with your client, for your own taxes, and for complying with the Stripe Connected Account Agreement. We may pause or remove payment features if an account is flagged for fraud or violates Stripe's rules.

6. Your content

You keep all rights to the audio, files, and other content you upload(“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content only to operate the Service for you — for example, streaming a mix to your client or assembling a finishing pack. We do not sell Your Content and we do not use your private audio to train AI models. You are responsible for having the rights and clearances to everything you upload and share.

7. Acceptable use

You agree not to:

  • upload or share content you don't have the rights to, or that infringes anyone's IP, privacy or other rights;
  • upload anything unlawful, malicious, or harmful (malware, illegal content, etc.);
  • abuse, reverse-engineer, scrape, overload, or attempt to break the Service or its security;
  • use Artyphonic to spam, defraud, or launder money;
  • resell or sublicense the Service except as expressly allowed.

8. Copyright & takedowns

We respect intellectual property and expect you to as well. If you believe content on Artyphonic infringes your copyright, send a notice with the details (the work, the infringing material's location, your contact details, and a good-faith statement) to legal@artyphonic.com. We will review and remove infringing material, and may suspend repeat infringers.

9. Client Rooms

A Room is private to the studio that owns it. As the studio, you decide what goes into a Room and who receives the link, and you are responsible for that content and for your client relationship. Room links are unguessable and can be revoked by the studio at any time. The client-facing Room is white-label — it carries your studio's identity, not ours.

10. The free tools

The producer tools (BPM, key, metronome, tuner, LUFS, and the rest) are provided free, in-browser, “as is”, for convenience. They are not professional advice and we make no guarantee of accuracy — don't rely on them as the sole basis for a critical decision.

11. Affiliate program

If you join our affiliate/referral program, you may earn a commission for qualifying referrals, tracked via our affiliate provider. You must promote Artyphonic honestly, comply with applicable advertising and disclosure laws, and not use spam, paid-search brand bidding, cookie-stuffing, or other prohibited tactics. We may withhold commissions for fraudulent or low-quality referrals and may end the program or your participation at any time.

12. Our intellectual property

The Service, the Artyphonic name and logo, the Phon mascot, the design, and all related software are owned by us and protected by law. We grant you a limited, revocable, non-transferable right to use the Service under these terms. You may not copy our branding or pass off the Service as your own beyond the white-label Room features we provide.

13. Termination

You can stop using Artyphonic and close your account at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; we may delete your data after a reasonable period (see the Privacy policy). Sections that by their nature should survive (content licence limits, disclaimers, liability, governing law) do.

14. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost — keep your own backups of important files.

15. Limitation of liability

To the fullest extent permitted by law, Artyphonic will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You agree to indemnify Artyphonic against claims arising from Your Content, your use of the Service, or your breach of these terms.

16. Governing law & changes

These terms are governed by and construed in accordance with the laws of Romania, and the courts of Bucharest, Romaniahave exclusive jurisdiction — without affecting any mandatory consumer-protection rights you have under the law of your country of residence. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We may update these terms; we will change the date above and, for material changes, give notice. Continued use after an update means you accept it.
